No Easy Decision: Pentagon Considering Punitive Action Against “No Easy Day” Author

Things are starting to heat up, many in the SEAL community are heading for the hills. It will be interesting when the book hits shelves on Tuesday. Warehouses are already stocked across the country and it seems there’s little the Pentagon can do to stop the initial run of books.

WASHINGTON, Aug. 31, 2012 – The Defense Department has sent an advisory letter of material breach and non-disclosure violation to a former Navy Seal who authored a book about his participation in the Osama bin Laden raid, Pentagon officials said here today.

In the book “No Easy Day,” the author, using the pen name “Mark Owen,” divulges information Navy SEALs used during the raid, which Pentagon officials said may contain classified information, putting military members at risk in future operations.

“The letter … is intended to put on record our very serious concerns about what we believe was a material breach of [a] non-disclosure agreement with the Department of Defense,” Pentagon Press Secretary George Little said. “We take these agreements and we take our obligation to protect classified information very seriously.”

In a letter sent to the publishing company and dated Aug. 30, DOD General Counsel Jeh Charles Johnson explained that Owen signed two separate non-disclosure agreements on Jan. 24, 2007, and that the author has an obligation to “never divulge” classified information.

Owen also signed a “Sensitive Compartmented Information Debriefing Memorandum” following his departure from the Navy in April 2012, and that commitment remains in force even upon leaving active duty, according to the DOD letter.

Since Owen elected to forgo pre-publication review with the department before publishing the book, the DOD is “weighing its options,” in terms of what legal actions it will pursue, Little said.

“The Department of Defense has obtained and reviewed an advanced copy of the book … In the judgment of the Department of Defense, you are in material breach and violation of the non-disclosure agreements you signed,” the letter said. “Further public dissemination of your book will aggravate your breach and violation of your agreements.”

“The Department is considering pursuing against you, and all those acting in concert with you, all remedies legally available to us in light of this situation,” the letter added.

Little said that commendable actions or current status do not indemnify Owen or any other past and present DOD employee from punitive action should they violate the terms of non-disclosure agreements.

“I would … applaud anyone who participated in one of the most successful military and intelligence operations in history,” Little said. “But even those who participated in such a mission have a serious and enduring obligation to follow the process and to help protect classified information.”

 @Rogue1 I just heard this on the evening news.  Sometimes I think Brandon has a crystal ball because he predicted something like this happening :(    I can't imagine Owen will be charged as he wasn't active duty at the time..but it will be interesting seeing how it plays out for him.

It is only after the George W. Bush presidency that the author begins complaining about the slow-moving “Washington machine” that members of the SEALs found frustrating. That irritation mounts in 2011, when the SEALs anxiously awaited their signal to raid Abbottabad, but this account is determined to steer clear of serious politics or leave itself open to election-season manipulation. The worst it has to say about President Obama is that none of the fighters who caught bin Laden wanted to help re-elect him, and that he never followed through on a promise to invite them to the White House for a beer.

I have 2 points.

1. Interestingly he made it political in terms of endorsing a candidate albiet indirectly. Had it come out after the elections perhaps next year it would have a different story.

2. Brandon Webb .. has repeatedly mention at multiple media forums that Barack Obama has no problems killing bad guys and Barack Obama has been good for the business as per other SEALs. The author's account is a little different here ???

 @IDRINKWATER I can give you my opinion, but I'm neither the author nor BW, so keep that in mind . .

 

Obama continued many of the policies already in place regarding the WoT and lets the military leaders do their thing.  He has been strong there or at least has not impeded action.

 

That being said, he has made other numerous decisions that affect the military and other national issues that are not popular. 

 

I'll guess we'll see how the vote stats pan out in November.

I would've given my left nut to have been on that job. I too will be grabbing a copy of the book but I do feel that trust has been betrayed. It will be interesting to see the legal developments in the coming weeks/months, I just hope that the relationship between government and the SEAL's or even the wider defence community isn't strained over this. I'm not a betting man but I reckon this book will overtake Andy McNabs 'Bravo Two Zero' as the biggest selling non fiction military book in history!

 Not when I got out, they may have changed those rules since though. I did get my book vetted but not by defence, a very senior member of the regiment red penned it for me to avoid delays and other associated hang up's.

 @SniperElite Interesting!  It just suddenly struck me - different countries may have different rules.  I bought your book, but am embarrassed to admit I haven't read it yet...my books to be read is now a "tower' of books.  I have a couple of close acquaintances who are former SASR - one served in Vietnam; one served later (Somalia among other places).  The younger has worked with researchers and authors and I never thought to ask if he had restrictions.  Thank you for answering my question - it was a bit nosey of me.

I don't understand why they are freaking out so much about it, most stuff is already open source, there are tons of videos on fast ropping, house and room clearing, small unit tactics, you can even get the ranger hand book, want to know the loadout just look at pictures on military photos forum, the rest is just boring procedures like how to setup mission briefs and so on, you can even find old green beret handbooks from the Vietnam era, now a days other than tiny technological leaps

 

theres not much that is not known in terms of gear and procedures, pretty much in terms of opsec left for the bin laden op at least is mostly number of participants, the teams who participated, where they left from stuff like that and even that was already leaked mostly, if you look at the trailer for the December movie that's coming out they even show you the type of nightvision they used, combine that with stuff that's been coming out in computer games there is not much left, they even have courses in tactical shooting techniques for civilians by ex sf operators.

 

I think in this case they are making all of this shitstorm because of a political situation there must be something in the book that makes the current administration look bad, funny thing is they are attracting even more attention to it, its already amazons number one best selling book and its not even out.

Getting pretty tired of hearing people throw opinions out in regards to OPSEC who have no idea what OPSEC is. And I want somebody to give me a legitimate example of an OPSEC violation in No Easy Day, Kill bin Laden, and other similar books that could ACTUALLY threatne the life of a serving operator.  @Iassen Donov As a consequence of the release of that guy's book, his identity was outed to the public. It won't take much for someone looking for him to find him, and there are hits being put out against him already.

 

He endangered himself, his family and others. That was a completely foreseeable outcome of his actions.

I don't trust any information that comes out of Washington. I never believe anything until it's Officially Denied. I see by George Little's own hand the Pentagon has invoked the "seriously worded" tone created as a comedy gaffe by the United Nations. Second, this is an election year where a Marxist usurper and Kenyan has managed through domestic and foreign intrigue to ascend illegally to the role of Commander in Chief. Maybe I'm just battle-fogged from the whip saw Left/Right deployment gripping our Nation's guts right now, but I analyze this as an Op put together with plenty of plausible deniability to go around. Meanwhile the agents-in-place occupying the White House are left holding the bag. The bag of lies they told. That said,using the reasoning that if the political brass leaks info,SOF personal should too, is totally missing the mark.While I did not serve in a SOF unit, I was an 0311 Infantry Marine with 2/5 from 1987 to 1990 and served 2 more years with a FAST platoon (Pacific) 

 

One of the enduring lessons of the Marine Corps is that all pols have an agenda,lie,cheat,steal and take credit when things go right while deflecting blame when things go wrong.

 

That being said,we are honor bound to follow the lawful orders of our civilian leaders even if they fail to live up to the same demanding standards we expect of ourselves.

 

Regardless of the behavior of our leaders,Marines (and the rest of the military) don't think honor is a punchline but a true way of life.We keep the faith when our political masters falter, and that means we don't use the excuse that "The President did it first".If Biss can make money sharing details of his heroic life,god bless him.If he failed to go through the proper channels that other operators and CIA Officers like Gary Berntsen(jawbreaker) went through getting their books published,he should be held accountable.What makes Biss better then brother warriors like Pete Blaber,Eric Haney,Don Mann,Dalton Fury,Howard Wasdin,William Boykin and other Tier 1 guys who had their books vetted prior to release.

 @blkyank   2016 doesn't call the Pres a marxist and it's not a hit piece.  It's actually not the birther BS hit piece the press tries to portray it as WHEN they address it.  It's scholarly, even keeled and full of facts you probably don't know.  The question is will you have the courage to see it so you can comment knowledgeably?

    • In the IDF, 'Lonely Soldier' is a term that describes soldiers serving on active duty who have no family is Israel. These are volunteers that came to serve for 3-5 years. They typically go back to their respective countries upon completion. Most commonly, these are people who immigrated to Israel by themselves. I was one of them. While in Israel, I lived in an apartment building where the majority of people were lonely soldiers. It was located on the outer ring of Jerusalem, surrounded by four Arab villages. My roommates were two recon guys (like me) and one who worked in field intel. All of the other inhabitants were soldiers from various units, with most of them serving a combat role. It was a well known thing, especially to the Arabs in the village. Most of the time we wouldn't be there, but when we were on leave, we would come to the apartment for a little R&R. It was rare that the four of us were there at the same time, but once in a blue moon, it did happen. Each village had, as is customary, its own mosque. When the time for prayer came, the loudspeakers would call out to the faithful. It was OK, we were used to it. However, over the weekend they would make it a point to play the call to prayer very, and I mean VERY, loud. They knew soldiers would be in the building trying to get some sleep - recovering from several weeks in the field. This always annoyed me but there was nothing I could do. On this particular weekend, after an intense seven weeks of non-stop ops, all I wanted was to go to the apartment, sleep, eat, sleep some more and then sleep again. That weekend the four of us were at the apartment and we were all equally tired. We arrived Thursday night and after a small dinner and some beers, we went to sleep. At 0400 we all jumped.... The freaking loudspeakers at all four mosques began their call to prayer at full blast. Fuck.... We spent the remainder of the day trying to rest and every time we would fall asleep, again... The call for prayers, full blast! Over lunch, we all looked at each other and knew this had to stop. We came up with a plan. I know it wasn't nice, but at that point we couldn't care less about political correctness. Here's what we did. After some recon that night, we noticed that the call to prayer wasn't performed by an Imam or some other person with a microphone. It was a tape recorder that used a tape. We figured the four of us, experts in stealthy infils, could sneak in and steal those tapes. However, while we were planning the different infil routes for each village, we all smiled and did something better. We recorded Metallica's 'For Whom the Bell Tolls' on repeat on all four tapes and then waited till midnight. At midnight, each one of us - armed with a Metallica tape - headed to a different village. All dressed in black, we were careful not to be seen. We entered into the buildings and exchanged the tapes. We rallied back to the exfil point, a crossroad not far from the last village and headed back to our apartment. And then we waited... At 0350 we went to the roof with some coffee, opened some field chairs and waited for the show to begin. At 0400 sharp the first "call" came alive, full volume: Make his fight On the hill in the early day Constant chill deep inside ... Take a look To the sky Just before you die It's the last time he will Followed by the next, then the 3rd and 4th joined in. Full volume Metallica! Soon after, we heard sirens headed to the villages. I don't know what happened after that, but we had our own private concert, right there. No kidding, there I was... Metallica call to prayer
