No Easy Profit. Pentagon Likely To Sieze Funds

I recently wrote an Op Ed for TIME and arrived at the conclusion that No Easy Day has a silver lining; it will be the tipping point for the SEAL community to reign in their PR machine and let the guys go back to being quiet professionals.

The stage is being set to discredit Bissonette and take all proceeds. McRaven recently visited DEVGRU to “talk” to the guys on the mission who of course would say Biss got it all wrong. Be careful what you read these days, the misinformation train has left the station. 

It begins….

The government can seize all profits received by former Navy SEAL Matt Bissonnette for his book “No Easy Day,” according to John L. Martin, who headed the Justice Department section that prosecutes spies and leakers of classified information.

Even if the book, written under the pseudonym Mark Owen, contains no classified information, the author breached his contract with the government by not submitting it for pre-publication review, Martin tells Newsmax.

Martin cites a 1980 Supreme Court decision upholding such a contract that was signed by Frank Snepp, a former CIA officer. In that case, no classified information was disclosed, but the proceeds from Snepp’s book were placed in trust for the government.

“In the Snepp case, he failed to submit his book for review, and the government seized the profits from the book,” Martin says. “Snepp took the case to the Supreme Court. So there is a Supreme Court decision on this very point that stands for the proposition that notwithstanding the fact that no classified information was published, the contract with the government prevails, and the former employee still has an obligation to put that book through pre-publication review and that the remedy for the government is the seizure of the profits.”

A lawyer and former FBI agent, Martin headed Justice Department espionage prosecutions for nearly 25 years and supervised the prosecution of 76 spies. They included John A. Walker Jr., a Navy warrant officer; Jonathan J. Pollard, a spy for Israel; Ronald Pelton, a former NSA employee; and Aldrich Ames, a CIA officer.

As it happens, the Pentagon has said the book does contain classified information. The book itself refers to the entire mission as being top secret. But Martin says, “You do not have to bring criminal charges against anyone, and you can punish him by seizing his profits, and you remove the incentive, which was the big point in the Snepp case — removing the incentive of making profits from breaching your contract with the government.”

In his book, Bissonnette says he is donating “most of the proceeds from its sale in honor of” the Navy SEALS who have lost their lives since 9/11. However, the Navy SEAL Foundation, one potential recipient, says on its website that it “will not be accepting any donations that are generated from the book or any related activities.” Martin says the proceeds would be seized by the government regardless of how they are spent

What will the Pentagon do with the money?  Why do they have a right to take money from a civilian? We have gone off the tracks during this discussion. I am as much to blame as anyone. The real question is did Matt do wrong or right by publishing No Easy Day. I know he broke his NDA and that is wrong. He made a mistake and now he is in trouble. He'll have to live with that. I still respect the man for all of his service to our country. I respect him because he is part of the brotherhood that I was privileged to be part of. I wish him the best and bear him no ill will.

Just finished NO EASY DAY. Good book. I don't see what all the excitement is about. Except for the different account of how UBL was KIA nothing really new. Perhaps the remarks about Obama and Biden set off a shit storm with the administration and now they want to hammer the author.

 @RVN SF VET  My older brother is a retired Marine MSgt.  He told me in the beginning about the tardiness of promotions in the Corps.  Biggest reason I went Army!  Little did I know my drinking and partying in Europe would have me a Pvt. E2 after 26 months in Germany, lol.  I was such a mess they sent my young ass to V.N. and it was there I found my 'home' finally.    6

 @RVN SF VET @HugeFan  SF, lol, ahhh the folly of our Youth!  We all thought we were invincible, and unless the 'wound' called for evac, it was Charlie Mike!  Little did we know we would someday be the 'old timers' and might Need what that P.H. could provide.  I hope your declining that honor has not cost you anything, physically or emotionally.

There was so much going on, awards not received, awards not earned, paperwork missing or not even submitted.

I still recall my frustration and as everyone knows, the anger and hurt can rear it's ugly head :(   Wish you taken it bro, I will Bet you did earn it.  I spent a lot of time in/out some of your camps and most were not the Hilton!  But that's another story too, lol.    R6

 @JHR  @StormR   Now that is excellent advice!  I thought that is what we all do when we don't want to waste our time with someone?  I always search for Stormy's comments, and yours, and a few other folks, first!  That is why I miss Matt and LCplX and Kat so much too.  Our little band of Merry people; as an old timer this site has given me so much and I resent hell out of it when I see someone hurt others, always have.

Being military I always felt it was my Responsibility and Duty to stand up for those not able,

I posted this same thing in the wrong place on this site. If OPSEC were ever a consideration of the US NAVY they would have kept the UDT name and trained every frog in counterinsurgency warfare etc. No need for a new name. The Trident would never have been authorized. We could have stayed with the Navy/Marine Corps Jump Wings and added the Scuba Badge like Recon. During the Vietnam War the ST-1 was selling t-shirts with Sammy SEAL (cloak and dagger) on the back. Not the behavior of a top secret unit. Isn't there a sign outside the SEAL TEAM Shh! compound that says Naval Special Warfare Development Group?

"Icegator" I could not find your comment but here is a reply. The author says,"Since May 1, 2011, everyone from President Obama to Admiral McRaven has given interviews about the operation. If my commander in chief is willing to talk, then I feel comfortable doing the same."

 

That's the problem. Lower ranking officers and NCOs have no business equating their actions with those of flag and general officers or the CinC. Rightly or wrongly, those folks are not bound by the same restrictions placed upon you. For one thing, they are a classifying/declassifying authority. For another, they are supposed to have better judgement and be wiser than us ordinary folk.

 

One thing is for sure, we ain't the same. There appears to be a triple standard: us, flag and general officers, and the CinC. Other politicians fall in there somewhere, but not with us!

In my opinion, If Mark wanted to publish a book about this mission and leverage his experiences as an ST6 operator he has every right as a "free citizen" of the United States of America. 

 

Unfortunately, I think his timing was rushed and because he failed to get this book vetted, I have to side with Uncle Sam on this one. 

 

It's a shame he probably won't see any proceeds from the book and his good intentions with military charities will not be forthcoming. Worse yet, he's been publicly named and bad guys all over the world will be looking for revenge. 

 

This is not the way it's supposed to go for America's heros.   Mark deserves to ride off into the sunset but it looks like this carnival show is coming to a screeching halt.  

 

Oh yeah, and let's not forget about his first class ticket to persona non grata over at ST6. Forever. 

 

In the long run the government needed to set the tone and preserve OPSEC.  it's just sad to see that one of our very best was hung out to dry in the process. 

 

To make the sacrifices Mark did and have nothing to show for it sucks.

 @Chairborne Commandos Radio I am a why gal. We all understand confidentiality agreements. The ramifications of not adhering to this can cause a civil or criminal pursuit. I agree with everything you said. Yet, deep down inside, I have this unshakable feeling that Matt did this for a reason, despite the conseqences. I have a few guesses as to why he did this. Vindication for lost lives is at the top of my guess list. A tribute to those he loved and lost. But then again, I know very little about this.

 

 I second that, I wish him the best.

My family has served since the mid 1600's. We are pretty patriotic. Mil, agencies, politics. para military, 1st responders, we are ALL over the board with service. Men and women. I am a fan of being a patriot and I honor all who serve.

 

 However, I am a FAN of saving lives in the mil and with Veterans. Thats my thing for the next 5 years. Stopping epidemics and a pandemic. Friends, loved ones and my son were hit with some illnesses, thus I jumped in to make a difference. I got mad, so I got involved.

I personally have never seen an exact number but rather estimates.  To my knowledge, the publisher has never released those figures so unless we hear from them or Mark it's all speculation to me. 

 

The "7 figures estimate" is a number we have talked about on SOFREP radio and is based on our personal relationship with other published authors and the collective experience of SOFREP dealing with the publishers direct and other media outlets.

 You All know I am a Tequila connoisseur. I have been keeping a notebook on Tequilas since the age of (too young to mention). After the serious "Viral Assault is poublished"....I am publishing The Tequila Diaries/Novella!OLE! with pics of the bottles and ratings of the Fine Tequila and funny stories of with whom, where and how much was consumed- and donating all proceeds to widows and children of those KIA. (Now I wonder if charities will take the money?)

 

BUT, when shit hits the fan, I have an odd craving for Schnaaps. I keep all flavors stocked including Root Beer Shnaaps! On Horse back, Hot Damn in snot freezing weather hits the spot. 80%+ proof, it burns and YES, is Cinnamon! On this adventure next week, I'll take a few bottles of frozen Hot Damn.  Penguin is managing risk. In this case they chose a storm that involves heavy government influence. That is like taking off in a Cessana 172 with very little fuel and climbing to 7 thousand to clear and perform power on stalls... Dont trust that instructor notdrake!!!!  @engelbrad There's a good bunch of existing case law from the Superior Court on down.  Bottom line, Mark signed NCND agreements and gave his word.  You gotta honor your word.  Mark didn't.

Wake up to today folks.. this fearless american hero "Mark" he went where most men wouldnt and thats into the face of danger and possible death in order to rid this world of those who have an want to harm us as people...not of any one county either people of the world. This "Mark" has every right to say "I am IRONMAN" and get that respect. To me he has already honored his word and he owes me nothing more as a taxpayer, He has every right to free speech. Honoring your word hmm....now thats not really A contract is it? Now im not privy to all the bells and whistles of some of you who can get that clearance however, as an American i do not see this "mark" any diffrent then that of a person who raised his arm in a 90 dgree fashion, took an oath and wrote a blank check that could be cashed in up to his life, served his time honorably in the Navy, and than had a story to tell. Look at Audi Murphy, look at gene Hackman, Oliver Stone , look around and realize that its ok to share these truths and writings that We all thrive off of these books, movies, wargames.. put down the torches and pick up these good men's books and watch their movies and just know....just know that while your sleeping in your beds, good men face real evil on our behalf.. Thanks for doing your job well guys and to those who have paid the ultimate price, everyday is memorial day for me. Rad

Yea, I got informed today on SOFREP with the NCND agreement. I think the "powers" are thinking out loud and testing winds as well as shooting over the bow of a ship that sailed. That said they may sink it. They could make this a great lesson with fewer causalities if they chose.

    • In the IDF, 'Lonely Soldier' is a term that describes soldiers serving on active duty who have no family is Israel. These are volunteers that came to serve for 3-5 years. They typically go back to their respective countries upon completion. Most commonly, these are people who immigrated to Israel by themselves. I was one of them. While in Israel, I lived in an apartment building where the majority of people were lonely soldiers. It was located on the outer ring of Jerusalem, surrounded by four Arab villages. My roommates were two recon guys (like me) and one who worked in field intel. All of the other inhabitants were soldiers from various units, with most of them serving a combat role. It was a well known thing, especially to the Arabs in the village. Most of the time we wouldn't be there, but when we were on leave, we would come to the apartment for a little R&R. It was rare that the four of us were there at the same time, but once in a blue moon, it did happen. Each village had, as is customary, its own mosque. When the time for prayer came, the loudspeakers would call out to the faithful. It was OK, we were used to it. However, over the weekend they would make it a point to play the call to prayer very, and I mean VERY, loud. They knew soldiers would be in the building trying to get some sleep - recovering from several weeks in the field. This always annoyed me but there was nothing I could do. On this particular weekend, after an intense seven weeks of non-stop ops, all I wanted was to go to the apartment, sleep, eat, sleep some more and then sleep again. That weekend the four of us were at the apartment and we were all equally tired. We arrived Thursday night and after a small dinner and some beers, we went to sleep. At 0400 we all jumped.... The freaking loudspeakers at all four mosques began their call to prayer at full blast. Fuck.... We spent the remainder of the day trying to rest and every time we would fall asleep, again... The call for prayers, full blast! Over lunch, we all looked at each other and knew this had to stop. We came up with a plan. I know it wasn't nice, but at that point we couldn't care less about political correctness. Here's what we did. After some recon that night, we noticed that the call to prayer wasn't performed by an Imam or some other person with a microphone. It was a tape recorder that used a tape. We figured the four of us, experts in stealthy infils, could sneak in and steal those tapes. However, while we were planning the different infil routes for each village, we all smiled and did something better. We recorded Metallica's 'For Whom the Bell Tolls' on repeat on all four tapes and then waited till midnight. At midnight, each one of us - armed with a Metallica tape - headed to a different village. All dressed in black, we were careful not to be seen. We entered into the buildings and exchanged the tapes. We rallied back to the exfil point, a crossroad not far from the last village and headed back to our apartment. And then we waited... At 0350 we went to the roof with some coffee, opened some field chairs and waited for the show to begin. At 0400 sharp the first "call" came alive, full volume: Make his fight On the hill in the early day Constant chill deep inside ... Take a look To the sky Just before you die It's the last time he will Followed by the next, then the 3rd and 4th joined in. Full volume Metallica! Soon after, we heard sirens headed to the villages. I don't know what happened after that, but we had our own private concert, right there. No kidding, there I was... Metallica call to prayer
