Senator Mark Kelly Sues Pentagon, Claims Trump Admin Violated Free Speech

Democratic Senator Mark Kelly sued the Pentagon on Monday, asking a federal court in Washington, D.C., to block a formal censure and related actions by Defense Secretary Pete Hegseth that could strip him of his retired Navy rank and reduce his retirement pay.

Kelly, a former US Navy officer and Arizona senator, argues that the censure stems from his participation in a November video urging US troops to uphold the Constitution and refuse unlawful orders, and that punishing him for that speech violates his First Amendment rights.

Hegseth announced the censure and opened proceedings earlier this month, calling Kelly’s remarks “seditious” and part of a broader Pentagon investigation.

Kelly’s lawsuit names Hegseth, the Department of Defense, and Navy officials as defendants and seeks to have the actions declared unlawful and unconstitutional.

The Pentagon has not yet responded to the lawsuit.
