The criteria for the award is,

The Use of Deadly Force Encounter Averted award is to recognize an employee who demonstrated clear situational awareness and courage while disarming a suspect using contact controls and verbal commands before the situation escalated to the use of deadly force. The act must demonstrate courage in the face of an armed suspect and result in no injury in accordance with agencies use of force policy. –CBP

The award appears to be for tactical mistakes that ended well, and mostly thanks to luck. That luck will need to be relied on if the award gains traction with internal policy, as the award criteria becomes an expectation and not the exception.

National Border Patrol Council Vice President Shawn Moran told Breitbart Texas in an interview Friday evening.

They want us to put ourselves in a bad tactical situation, this could lead to one of our agents getting killed.

A logical statement, as word will spread that violent and aggressive criminals will conceivably have a free pass, that is if they are willing to risk drawing a weapon and escape arrest.  Are we sending the message that if you’re willing to kill; we won’t stop you?


The award finds its roots from the secured offices of the American Civil Liberties Union, an edict rich with muckraking was sent forth, ACLU Recommendations Regarding Use of Force by U.S. Customs and Border Protection Officers. The document was pushed, lobbied, and marketed to demonize the already understaffed, overworked, and heavily regulated Customs and Border Patrol Agents. Part of the on-going and misguided ACLU faulty powers campaign, which effectively targets everyone except policymakers in Washington and offenders.  A similar strategy was launched against the LAPD who similarly implemented a like award titled, “Preservation of Life Award.”


Though it’s worse than you think, CBP Agents are facing even less time in the field to deter any such crimes. CBP Agents encountering increased personnel resource management difficulties as they attempt to maintain the pace for processing aliens, necessitating pulling Agents off the line to document and transport aliens.

This in-turn increases the odds of an outnumbered and outgunned agent in the field, getting hurt or worse.

The alien files that agents have to process include a specific order of precedence. The priority is: Unaccompanied Alien Children, Family Groups with Children, and then Criminal Prosecutions.

The problem is that those facing Criminal Prosecution are the only group with a 48-hour time limit of detention; and within that time limit they must be presented. Failing that, agents will have violated their Constitutional guarantee to a speedy trial.

Unfortunately, CBP Agents rarely get to prosecute criminal aliens, other than the especially bad ones (murderers and sex offenders.) Most fall through the cracks to continue the lifestyle of a career criminal, which is becoming a significantly less hazardous lifestyle for border criminals.
